SHAVARSH KOCHARYAN STOLE THE CONSTITUTION
The president of the Union of Political Scientists Hmayak Hovanisyan stated July 24 at the Iravunk de facto club he agrees with Stepan Demirchyan that Robert Kocharyan should be brought before justice in Armenia for his crimes, for the order to fire at people. He said it would have been better but it is impossible considering the judicial system of Armenia, therefore they apply to the Court of The Hague. The political scientist said the amendments to the Constitution of Armenia which were adopted in 2005 included a provision which was set down in Article 56.1 of the Constitution that after leaving office the presidents cannot be brought before justice for actions which stem from their powers. Hmayak Hovanisyan says Robert Kocharyan was the supreme commander-in-chief and his powers involved order to fire at people, if he felt a threat to security. In that case, according to Hmayak Hovanisyan, Kocharyan could have taken a proportionate action and he could have said that he considered firing proportionate at that time. Hmayak Hovanisyan said the amendments to the Constitution grant immunity to ex-presidents, in particular to Kocharyan, therefore he can be brought before justice only through the court of The Hague. The political scientist said he was against that provision in 2005, whereas, according to Hmayak Hovanisyan, Shavarsh Kocharyan was one of the ardent champions of that provision, meanwhile now, according to Hmayak Hovanisyan, he is being pharisaic and says the initiative to bring Robert Kocharyan before the International Court of Justice favors Azerbaijanis. In this connection Hmayak Hovanisyan said he had stated that an attempt is made to steal the Constitution and rights from people through Shavarsh Kocharyan. Hmayak Hovanisyan also stated that Robert Kocharyan should have begged to take him to The Hague because this is the only way to repent for everything Robert Kocharyan has done.
