
LEGAL INITIATIVE CONTINUES
Three NGOs, the Civil Society Institute, the Armenian Committee of the Helsinki Citizens’ Assembly and the Free Forum for Civil Initiatives, together with their partners in the regions and Yerevan, launched the Legal Initiatives program in 2007 which involved a hot line and legal advice to those people who needed it, voters, proxies, members of election commissions, observers, presidential candidates. After the parliamentary election the program was suspended because applications for legal advice stopped. However, it was resumed before the presidential election, and although it was to last till March 1, it continues because applications for legal advice and calls by the hot line continue, said the heads of the NGOs which participate in the program in a news conference on May 7. They say every day they receive 2-6 phone calls from people who ask for legal advice on how to protect their rights. “Phone calls continued to come after the election, and multiplied after the events of March,” says Artak Kirakosyan, the head of the Civil Society Institute. According to him, in most cases the problem is the actions of the law enforcers. The lawyer of the program Ani Nersisyan says most people who call complain of willful actions of the police. In Gyumri, for instance, they illegally sealed a shop and told its owner they would not open it until his son who was hiding turned up. The owner of the shop called them and asked for help. They advised him to write an application to the chief of the police of the region. The citizen did but the application was not received. Afterwards, however, the policemen returned and opened the shop they had sealed illegally, and threatened that he will regret after they find out where his son is. There was another case of willful actions of the police in Yerevan. The police detained a citizen from his home and kept his place secret for two days. The family appealed to the Legal Initiative. Two days later it became known that the citizen was at the office of prosecutor for an interrogation. Afterwards he called home and said he needs a lawyer. The relatives said his voice was desperate. When the lawyer of legal initiatives, after lasting talks with the investigator, was finally allowed to meet the citizen, he said he did not need a lawyer. Meanwhile, the relatives had been told that he needed a lawyer, says Ani Nersisyan, the lawyer of the Legal Initiatives, noting that maybe the citizen was made to waive the lawyer. The lawyer also says policemen visited some participants of the march on April 24 and threatened them not to participate in any march and think for their children or grandchildren. Artak Kirakosyan says most citizens think if they do not pursue their rights and obey the law enforcers, it will make their lives easier. Artak Kirakosyan says it is wrong. The representatives of the Legal Initiative say there is a problem with raising the legal awareness of citizens because very often people sign papers at police stations without reading what is written in those papers. Artak Kirakosyan says the purpose of the Legal Initiatives is not only to protect the rights of citizens relating to the events of March 1 but also to provide legal advice in case of other violations of human rights. The Legal Initiatives program is funded by the USAID, and the size of assistance is about 60 thousand dollars.
