- “At the first instance court of Syunik the work of the attorneys was raped, the law did not work, no article of the criminal code worked, one of the relatives shouted abuse and attacked us with a stick, the judges got angry with our solicitations, whereas the decision of the Court of Appeal to dismiss our defendants and hear the case again was unprecedented and unexpected,” stated the attorneys of Arayik Musayelyan, Musa Serobyan, Razmik Sargsyan accused of the murder of two servicemen of the military unit of Mataghis Roman Yeghiazaryan and Hovsep Mkrtumyan Zaruhee Postanjyan, Ashot Atoyan and Stepan Voskanyan at the Friday Club on December 25. These servicemen were accused of the murder of servicemen of their military unit and were sentenced to 15 years by the first instance court of the region of Syunik. The Court of Appeal changed the verdict and sentenced for life. The Court of Appeal decided on December 22 to release the three servicemen and start additional investigation. The attorneys say this is a historical decision.
During the news conference the attorneys said they felt at both the first instance court and the court of cassation that there was an instruction to accuse these three young men, the instruction came from the deputy of the Attorney General of Armenia Gagik Jahangiryan. Meanwhile, “there is a lot of evidence tracking to the command of the military unit starting from the commander of the battalion,” the attorneys state.
This decision of the Court of Cassation is unprecedented in the modern history of Armenia. The attorneys consider it their victory and the victory of human rights organizations, NGOs and the mass media.
However, the attorneys and their defendants are not likely to stop. They are going to sue Gagik Jahangiryan, the judge of the first instance court of the region of Syunik Volodia Manaseryan, the judge of the Court of Cassation Mher Arghamanyan and another 10 people, including officials of the Military Police, judges, the doctor of the penitentiary. The attorneys provided facts that these people were involved in torturing their defendants and other offenses. “There were so many mistakes during the investigation that we thought the case would come to its end in the first instance court.”
