STRASBOURG LESSONS FOR ARMENIA: COURT DECISION SPARKS PM CALL FOR CAUTION
The European Court of Human Rights has ruled against an Armenian court in a four-year old dispute between a citizen and the state tax service. While it is the fifth time the Strasbourg court has overruled an Armenian court’s decision since Armenians became eligible for appeal in 2002, the case is significant beyond the result as it has drawn the attention of Prime Minister Tigran Sargsyan who said that Armenia needs to pay more attention to its processes and to protect its international image. ArmeniaNow attempted several times on Monday to get details of the case from the Ministry of Justice, but the ministry did not provide information. Meanwhile, Arni Legal AID firm lawyer Ara Ghazaryan told ArmeniaNow that the case reached the European court after the plaintiffs were refused a hearing by the Cassation Court of Armenia. The case stems from a dispute involving Paykar & Haghtanak Ltd. and the tax inspectorate in which the latter’s court action against the company for failing to meet its tax obligations was sustained by the court of the first instance. After failing at the appeals court, the company applied to the Court of Cassation, which refused to take up the examination of the case for a reason that was recognized as invalid by the European Court. (Another case was closed at the European Court in spring 2007 after Armenia’s government achieved a negotiated settlement with plaintiff Gevorg Chghlyan, one of the numerous persons affected by development of Northern Avenue, paying him an equivalent of $150,000 in drams.) Prime Minister Sargsyan said the report by Justice Minister Gevorg Danielyan would be sent to all law-enforcement bodies to draw conclusions and prevent such cases in the future. “I think that the decision of the European Court of Human Rights is absolutely fair and our shortcomings and omissions are patent,” he said. The prime minister’s remarks came amid a period when prosecutors and judges in Armenia face an unprecedented number of court trials stemming from the post-election events. Sargsyan also introduced a novelty in the government’s workings by instructing his deputy and Minister of Territorial Administration Armen Gevorgyan to conduct an internal inquiry into the story published by the Aravot daily on April 23 alleging that Syunik governor Suren Khachatryan had beaten a 12-year-old boy in Goris. “Our work with mass media will change from now on. In particular, the first principle that the republic’s president has set to us is as follows: if we want to have responsible media, first of all we must have responsible authorities. What does it mean? From now onward, we ought to respond to publications concerning events of great public importance that appear in the media,” Premier Sargsyan said during the government sitting that was for the first time available online to accredited media representatives at the government’s press center.
