SCHOOLS AND POLITICS: TEACHER SAYS HE WAS FIRED BECAUSE OF HIS POLITICAL VIEWS
- Nairi Aroyan, a school teacher in the Lori province became unemployed after the February presidential elections. Aroyan says he was fired from his job in the school because he supported the candidacy of the Levon Ter-Petrosyan. “Firing was a political order,” says Aroyan, 50, a teacher of physics and human rights in the village of Amrakits of Lori province. Aroyan is a member of the People’s Party of Armenia. Aroyan missed the lessons during the election time and did not go for work during the election, but was instead involved in election processes as a precinct commission member. Aroyan says he had informed the management of the school on his plans as he submitted a document confirming his being a commission member but as he states the management did not take into his document into account. “They called me out of the classroom in the morning of March 6 saying I should not go back into the classroom,” recalls the teacher. Instead he was given an excerpt from the order on his dismissal that said he was fired on February 18th. The order on Aroyan’s dismissal signed by the director of the school Ara Janjughazyan is based on several articles of the Labor Code of Armenia. The articles of law cited by the director basically substantiated the dismissal with Aroyan’s “not fulfilling or improper fulfillment of work duties as well as absence from the workplace during the whole workday for inexcusable reasons.” The director mentions in the passage from the order Nairi Aroyan missed the lessons between February 11 and 16 for inexcusable reasons. “I have the right to miss the work throughout the whole election period as a commission member,” Aroyan recalls the Election Codebook. He believes his absence during the election time has been just an excuse for the management of the school to dismiss him as the true reason, he says, is his political views. The director of the school disagrees. He says the dismissal is by no means tied up to his political views. “There is no place for politics here. I have not taken into account if he has been at the Liberty Square or if he is an oppositional,” says Janjughazyan, adding that he there were more cases of Aroyan’s absence, for instance one between the Election Day to March 3. Instead Aroyan was offered by the school’s principal to bring a fake document to excuse his absence, but he refused. “I was allowed (by law) to be absent form work even after the voting day, as long as the election process is not over. If the election results are protested in the Constitutional Court, it means the election process is not over,” Aroyan says. There is still no replacement for Aroyan at teaching physics and human rights. He has decided to appeal to court to restore his job. This is not a novelty for Aroyan. He says he was fired when he participated in opposition rallies on April 12 and 13, 2004. An appeal court restored his position.
