In reply to our question if the verdict of the European Court presumes restoration of the right, Tigran Ter-Yesayan stated: “The European Court only demands “recognition of rights” and the EC Committee of Ministers raises the necessity of restoring the rights of the particular person or organization.”
By the way the EC Committee of Ministers is open to reports during the execution of the verdict reminding and obliging the responsible side to restore the violated rights of the applicant.
“Is this, in the legal sense, a more significant document than the PACE resolutions, where it was constantly demanded to provide conditions for the restoration of “A1+” broadcasting rights?” “It certainly is. It’s a verdict of a court and you can hardly find any other suchlike verdict among all the judgment s of the European Court. It is a unique resolution.”
“I am happy that we have won. The “A1+” staff knew that their rights had been violated but the problem could have been solved in the local court. I am sorry to have involved the European Court in this matter. Being in the judicial process the company lost much. So did the society as getting information is one of its rights. It is good news but we must draw conclusions”, Ter-Yesayan concluded.
