“IS THE JUDGE AFRAID OF LOSING CHAIR?”

“Armenia’s Council of Justice has recently asked President Robert Kocharian to terminate the powers of a district court judge Pargev Ohanian in a move seen by many as retaliation for his controversial acquittal of two businessmen. Presently, I feel an atmosphere of fear in the courtroom. Suren Ghazarian is afraid of losing his chair. Ghazarian cannot treat the matter objectively, therefore I announce a demur,” advocate Ashot Sargsian told Suren Ghazarian, a judge of the RA Court on Criminal and Marshal Issues.
Ashot Sargsian’s speech was welcomed with warm applauses.
To remind: Gagik Hakobian, the owner of the Royal Armenia Company, and one of its top executives, Aram Ghazarian, were arrested in 2005 after publicly accusing senior customs officials of corruption. They are charged with smuggling, tax evasion and document forgery.
Gagik Hakobian was tried and acquitted. On October 3, 2007, Hakobian was detained at Zvartnots airport the moment he returned from Spain.
The advocate stated that Hakobian’s arrest was unwarranted. He was simply undergoing treatment in Spain, and the court was well aware of it. “Gagik Hakobian has returned of his own accord and was taken into custody by a court’s decision,” Sargsian noted.
The rejection was also grounded on the change of restraint. The plaintiff objected to this saying that Gagik Hakobian is accused of a major crime. He might endanger the legal proceedings and threaten the plaintiff – the director of FIG Company Vache Petrosian.
After 30 minutes' consultation, the court found the rejection groundless and turned it down.
The next sitting is due on October 18.
